| As your hosting company we are just that a hosting
company.... We provide you space on our system and allow you to post your site.
We also provide you technical support in developing your site were we can but are not
responsible for the development of the site directly this must be handled by you or
a development company. Although we do perform regular
backups of data we recommend that you keep a copy of your information on
your local system, as we are not responsible for data corruption and
loss of data We also are not responsible for any content or unauthorized access's to your
site as we do not have any control over whom you distribute your password to... but we
will gladly change your password anytime you feel the need to do so...
We do not allow any adult content to be stored on our systems or any non adult content
that is for use on an adult site. We also do not allow any types of
warez sites or
sites that distribute any type of protected intellectual properties...
Further more if your site is accessed by unauthorized means it is your responsibility
to secure your own site and replace any deleted or removed files..... We are not
responsible for lost income due to lax securities and password cracking...
You are responsible for all transactions on your site we will not delivery of nor will
we replace any electronic media lost or untransferred from your site...
LIMITED LIABILITY. SELLER shall not be liable under any circumstances for any
special, consequential, incidental or exemplary damages arising out of or in any way
connected with this agreement or the product, including but not limited to damages for
lost profits, loss of use, lost data, third party service bills, loss of privacy, damages
to third party even if SELLER has been advised of the possibility of such damages. The
foregoing limitation of liability shall apply whether any claims based upon principles of
contract, warranty, negligence or other tort, breach of any statutory duty, principles of
indemnity or contribution, the failure of any limited or exclusive remedy to achieve its
essential purpose or otherwise.
Governing Law. This Agreement was entered into in the State of Oregon and its
validity, construction, interpretation and legal effect shall be governed by the laws and
judicial decisions of the State of Oregon applicable to contracts entered into and
performed entirely within the State of Oregon.
Choice of Forum. Any action at law or in equity arising under this Agreement
shall be filed only in Courts of the State of Oregon for the County of Multnomah or the
United States District Court for the Northern District of Oregon. The parties hereby
consent and submit to the personal jurisdiction of such courts for the purposes of
litigating any such action.
